I am a business owner with no employees. Am I still required to have Work Comp?
The State of Colorado does not require sole proprietors, or business owners with no employees to cover themselves with a Workers Compensation policy. However, you may be required to have Workers Compensation to fulfill a contractual requirement with a company you are doing work for.
My family members are my Employees. Do I still need to have a Workers Compensation policy?
YES. The Workers Compensation Act states that any individual who performs work for you is an employee unless the individual is:
- Free from control and direction in the performance of their job
- Customarily engaged in an independent trade, occupation or profession business-related business related to the service being provided
